Is Takaful permissible? Is insurance permitted for a Masjid?

Question:

Muhtaram Dear Mufti Saab        

1) Is takaaful permissible?

2) Can a Musjid be insured?

3) I lack concentration in Salaat, what can I do?

والسلام عليكم

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

Many Takaaful schemes are impermissible because while the providers claim that their Takaaful schemes are Shari’ah compliant, they are simply insurance schemes with a different name[1]. Therefore, a Takaaful scheme will be only be permissible provided that all the clauses in the contract are within the ambit of Shari’ah. To ensure that the Takaaful contract is Sharia’ah compliant, it needs to be presented to a reliable scholar or Darul Ifta for verification.

The general rule is that all forms of conventional insurance are Haram. So, in normal circumstances will not be permissible to insure the Masjid. However, in areas where there are riots and attacks on Muslim properties, the scholars have given the allowance for a Masjid to be insured. In such a case it will only be permissible to use the amount of money that was paid as premium for the insurance. Any extra money should be given away in charity to the poor and needy. If there is the need to use the all the insurance money, the amount that is above the premium should be used to build toilets and bathrooms.[i]

In order to improve concentration in Salaah, ensure that the proper etiquettes of using the toilet and Wudhu are followed. In addition, the etiquettes of Salaah should be observed. Try to learn and focus on the meaning of what is being said in the different postures of Salaah and do each posture properly without rushing it. While in Salaah keep the gaze on:

  • The place of Sajdah while in Qiyaam (standing)
  • The top of the feet while in Ruku
  • The tip of the nose while in Sajdah
  •  The thighs while in Qa’dah (sitting position)
  • The left and right shoulder while make Salaam[ii].

Finally, make Dua to Allah and ask Him to bless you with the ability to concentrate in Salaah.
