Will Janazah be performed on a baby after miscarriage?

Question

Assalamu alaikum.
When one has a miscarriage, how far along does the fetus hve to be to necesitate a janazah?
And is this janazah done like a normal janazah?

Answer

بسم الله الرحمن الرحيم

If a baby shows some signs of life at the time of birth before dying, e.g. crying, moving, breathing, etc., the baby will be named, given a ghusl, shrouded and Janazah Salah will be performed, thereafter the baby will be buried (i.e. the normal procedure of Islamic ghusl and shrouding).

If, however, there were no signs of life at the time of delivery (i.e. stillborn), Janazah Salah will not be performed, rather, the baby will only be named, washed, wrapped in a single cloth, and buried.  Similarly, is the case of a miscarriage. (i.e. Janazah Salah will not be performed).

Furthermore, in a miscarriage, if some limbs of the fetus were developed i.e. some parts were discernible e.g. hands, feet, finger, nose, etc., the fetus is given a name, washed, wrapped in a cloth and buried (without Janazah Salah being performed). If not, (i.e. limbs were not formed) it will just be wrapped in a cloth and buried. [1]

وفي الخانية والخلاصة والفيض والمجموع، وفي تسميته كلام قاله الشيخ إسماعيل (قوله ولعله سبق نظرهما إلخ) قال في النهر ما في الخلاصة عزاه في الدراية إلى المبسوط والمحيط أفسبق نظر السرخسي وصاحب المحيط أيضا كلا، وفي الظهيرية السقط الذي لم تتم أعضاؤه لا يصلى عليه باتفاق الروايات واختلفوا في غسله والمختار أنه يغسل ويدفن ملفوفا بخرقة وعزاه الشيخ إسماعيل إلى النهاية قال وجزم به في عمدة المفتي والفيض والمجموع والخانية والمبتغى ثم قال: وبهذا يظهر ضعف ما في المنبع من أنه لا يغسل إجماعا، وفي شرح ابن الملك وغرر الأذكار اتفاقا، وما في البحر غير واضح بل الظاهر تضعيف الإجماع والاتفاق. اهـ
