I am residing in Jeddah, can I perform Salah in Haram without doing Umrah?

Question:

Asslau Allaikum wrwb

I recently moved to Jeddah for a job and then visited Macca and masjidul haram 2 days later. Because of hajj season and instruction from my employer and friends I did not make intention for umrah and only visited for 2 hours, performed maghrib and isha prayers and return home. Is there any thing wrong with that? I have already performed Hajj and Umrah in the past so this was not my first visit to kaaba but I really wanted to see the house of Allah and inshaAllah return for umrah after the hajj is over this year. Please advise if I did anything wrong and if so then what is the kaffara for that.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If your intention was to stay in Jeddah for 15 days or more, then you would be a Muqeem (resident) in Jeddah. The ruling for a Muqeem inside the Meqaat (the stations at which pilgrims on Hajj and Umrah are required to put on ihram) is he may enter the Haram without Ihram or without performing Umrah .
Thus, in the enquired case, if you were a Muqeem of Jeddah, and you travelled from Jeddah to The Haram to perform Salah then you did not need to perform Umrah upon entering The Haram.

(قَالَ): وَإِنْ أَرَادَ الْكُوفِيُّ بُسْتَانَ بَنِي عَامِرٍ لِحَاجَةٍ فَلَهُ أَنْ يُجَاوِزَ الْمِيقَاتَ غَيْرَ مُحْرِمٍ؛ لِأَنَّ وُجُوبَ الْإِحْرَامِ عِنْدَ الْمِيقَاتِ عَلَى مَنْ يُرِيدُ دُخُولَ مَكَّةَ، وَهَذَا لَا يُرِيدُ دُخُولَ مَكَّةَ إنَّمَا يُرِيدُ الْبُسْتَانَ، وَلَيْسَ فِي تِلْكَ الْبُقْعَةِ مَا يُوجِبُ التَّعْظِيمَ لَهَا فَلِهَذَا لَا يَلْزَمُهُ الْإِحْرَامُ، فَإِذَا حَصَلَ بِالْبُسْتَانِ، ثُمَّ بَدَا لَهُ أَنْ يَدْخُلَ مَكَّةَ لِحَاجَةٍ لَهُ كَانَ لَهُ أَنْ يَدْخُلَهَا بِغَيْرِ إحْرَامٍ؛ لِأَنَّهُ لَمَّا حَصَلَ بِالْبُسْتَانِ حَلَالًا كَانَ مِثْلَ أَهْلِ الْبُسْتَانِ وَلِأَهْلِ الْبُسْتَانِ أَنْ يَدْخُلُوا مَكَّةَ لِحَوَائِجِهِمْ مِنْ غَيْر إحْرَامٍ فَكَذَلِكَ هَذَا الرَّجُلُ، وَهَذَا هُوَ الْحِيلَةُ لِمَنْ يُرِيدُ دُخُولَ مَكَّةَ مِنْ أَهْلِ الْآفَاقِ بِغَيْرِ إحْرَامٍ

بدائع الصنائع في ترتيب الشرائع (2/ 169)
وَمَنْ كَانَ بَيْنَهُ وَبَيْنَ مَكَّةَ مَسَافَةٌ لَا تُقْصَرُ فِيهَا الصَّلَاةُ؛ لِأَنَّهُ إذَا كَانَ كَذَلِكَ كَانَ مِنْ تَوَابِعِ مَكَّةَ، وَإِلَّا فَلَا، وَالصَّحِيحُ قَوْلُنَا؛ لِأَنَّ الَّذِينَ هُمْ دَاخِلُ الْمَوَاقِيتِ الْخَمْسَةِ مَنَازِلُهُمْ مِنْ تَوَابِعِ مَكَّةَ، بِدَلِيلِ أَنَّهُ يَحِلُّ لَهُمْ أَنْ يَدْخُلُوا مَكَّةَ لِحَاجَةٍ بِغَيْرِ إحْرَامٍ، فَكَانُوا فِي حُكْمِ حَاضِرِي الْمَسْجِدِ الْحَرَامِ.

(قَوْلُهُ اعْتِبَارُ الْإِرَادَةِ عِنْدَ الْمُجَاوَزَةِ) أَيْ أَنَّ الْآفَاقِيَّ الَّذِي جَاوَزَ وَقْتَهُ تُعْتَبَرُ إرَادَتُهُ عِنْدَ الْمُجَاوَزَةِ، فَإِنْ كَانَ عِنْدَ قَصْدِ الْمُجَاوَزَةِ أَرَادَ دُخُولَ مَكَّةَ لِحَجٍّ أَوْ غَيْرِهِ لَزِمَهُ الْإِحْرَامُ مِنْ الْمِيقَاتِ، وَإِلَّا بِأَنْ أَرَادَ دُخُولَ مَكَان فِي الْحِلِّ لِحَاجَةٍ فَلَا شَيْءَ عَلَيْهِ
