Statments of Kufr?

Question:

Aslaamualaikum

I pray you are well.

Could you please shed some light.
If a Muslim has a habit of breaking and restarting his Namaaz/Salaah. So before he starts his Namaz/Salaah, he (with intention)in the mind : “if I break my Namaz without completing it then I’m a kaafir”, or “If I break my Namaaz/Salaat then i will become a kaafir today for sure”, or, “one last time otherwise it’s kufr” or “one last time otherwise I’m a kaafir” (i.e. just this once he will read and complete his Namaz/Salaah without breaking and restarting). However he breaks and restarts once or many times even after the above intentional thinking to himself. Does doing this or the above thinking or verbal saying or doing any of the above explained cause kufr?

 

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The mentioned statement will not constitute Kufr[1]. However, sincere Istighfaar and Tawbah (repentance) should be made and in future such statements must be refrained from, even in frustration.

Regarding the explanations in your question, the situation is a kind of “Waswasa” (misgivings and whispers of Satan). One must remember that Shaitaan is the accursed and his objective is to try to distract man from the worship of Allah Ta’ala and lead him astray. The present dilemma that one is facing is from amongst his evil tricks.

Try one’s best to ignore these doubts from Shaitaan. Whenever these thoughts arise, discount them with the recitation of أَعُوذُ بِاَللَّهِ مِنْ الشَّيْطَانِ الرَّجِيمِ)) and) (لا حول و لا قوة الا بالله. Implore Allah Ta’ala in Dua to relieve one’s predicament. Dua is the most powerful weapon of the believer.

بدائع الصنائع في ترتيب الشرائع (3/ 8)

وَلَوْ قَالَ إنْ فَعَلَ كَذَا فَهُوَ يَهُودِيٌّ أَوْ نَصْرَانِيٌّ أَوْ مَجُوسِيٌّ أَوْ بَرِيءٌ عَنْ الْإِسْلَامِ أَوْ كَافِرٌ أَوْ يَعْبُدُ مِنْ دُونِ اللَّهِ أَوْ يَعْبُدُ الصَّلِيبَ أَوْ نَحْوُ ذَلِكَ مِمَّا يَكُونُ اعْتِقَادُهُ كُفْرًا فَهُوَ يَمِينٌ اسْتِحْسَانًا وَالْقِيَاسُ أَنَّهُ لَا يَكُونُ يَمِينًا وَهُوَ قَوْلُ الشَّافِعِيِّ.

وَجْهُ الْقِيَاسِ أَنَّهُ عَلَّقَ الْفِعْلَ الْمَحْلُوفَ عَلَيْهِ بِمَا هُوَ مَعْصِيَةٌ فَلَا يَكُونُ حَالِفًا كَمَا لَوْ قَالَ إنْ فَعَلَ كَذَا فَهُوَ شَارِبٌ خَمْرًا أَوْ آكِلٌ مَيْتَةً.

وَجْهُ الِاسْتِحْسَانِ أَنَّ الْحَلِفَ بِهَذِهِ الْأَلْفَاظِ مُتَعَارَفٌ بَيْنَ النَّاسِ فَإِنَّهُمْ يَحْلِفُونَ بِهَا مِنْ لَدُنْ رَسُولِ اللَّهِ – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – إلَى يَوْمِنَا هَذَا مِنْ غَيْرِ نَكِيرٍ وَلَوْ لَمْ يَكُنْ ذَلِكَ حَلِفًا لَمَا تَعَارَفُوا لِأَنَّ الْحَلِفَ بِغَيْرِ اللَّهِ تَعَالَى مَعْصِيَةٌ فَدَلَّ تَعَارُفُهُمْ عَلَى أَنَّهُمْ جَعَلُوا ذَلِكَ كِنَايَةً عَنْ الْحَلِفِ بِاَللَّهِ – عَزَّ وَجَلَّ – وَإِنْ لَمْ يُعْقَلْ.

وَجْهُ الْكِنَايَةِ فِيهِ كَقَوْلِ الْعَرَبِ لِلَّهِ عَلَيَّ أَنْ أَضْرِبَ ثَوْبِي حَطِيمَ الْكَعْبَةِ إنَّ ذَلِكَ جُعِلَ كِنَايَةً عَنْ التَّصَدُّقِ فِي عُرْفِهِمْ وَإِنْ لَمْ يُعْقَلْ وَجْهُ الْكِنَايَةِ فِيهِ كَذَا هَذَا، هَذَا إذَا أَضَافَ الْيَمِينَ إلَى الْمُسْتَقْبَلِ فَأَمَّا إذَا أَضَافَ إلَى الْمَاضِي بِأَنْ قَالَ هُوَ يَهُودِيٌّ أَوْ نَصْرَانِيٌّ إنْ فَعَلَ كَذَا لِشَيْءٍ قَدْ فَعَلَهُ فَهَذَا يَمِينُ الْغَمُوسِ بِهَذَا اللَّفْظِ وَلَا كَفَّارَةَ فِيهِ عِنْدَنَا لَكِنَّهُ هَلْ يُكَفَّرُ؟ لَمْ يُذْكَرْ فِي الْأَصْلِ وَعَنْ مُحَمَّدِ بْنِ مُقَاتِلٍ الرَّازِيّ أَنَّهُ يَكْفُرُ لِأَنَّهُ عَلَّقَ الْكُفْرَ بِشَيْءٍ يُعْلَمُ أَنَّهُ مَوْجُودٌ فَصَارَ كَأَنَّهُ قَالَ هُوَ كَافِرٌ بِاَللَّهِ وَكَتَبَ نَصْرُ بْنُ يَحْيَى إلَى ابْنِ شُجَاعٍ يَسْأَلُهُ عَنْ ذَلِكَ فَقَالَ لَا يَكْفُرُ وَهَكَذَا رُوِيَ عَنْ أَبِي يُوسُفَ أَنَّهُ لَا يَكْفُرُ وَهُوَ الصَّحِيحُ لِأَنَّهُ مَا قَصَدَ بِهِ الْكُفْرَ وَلَا اعْتَقَدَهُ وَإِنَّمَا قَصَدَ بِهِ تَرْوِيحَ كَلَامِهِ وَتَصْدِيقَهُ فِيهِ وَلَوْ قَالَ عَصَيْتُ اللَّهَ إنْ فَعَلْتُ كَذَا أَوْ عَصَيْتُهُ فِي كُلِّ مَا افْتَرَضَ عَلَيَّ فَلَيْسَ بِيَمِينٍ لِأَنَّ النَّاسَ مَا اعْتَادُوا الْحَلِفَ بِهَذِهِ الْأَلْفَاظِ.

وَلَوْ قال إنْ فَعَلَ كَذَا فَهُوَ يَهُودِيٌّ أو نَصْرَانِيٌّ أو مَجُوسِيٌّ أو بَرِيءٌ من الْإِسْلَامِ أو كَافِرٌ أو يَعْبُدُ من دُونِ اللَّهِ أو يَعْبُدُ الصَّلِيبَ أو نَحْوُ ذلك مِمَّا يَكُونُ اعْتِقَادُهُ كُفْرًا فَهُوَ يَمِينٌ اسْتِحْسَانًا كَذَا في الْبَدَائِعِ حتى لو فَعَلَ ذلك الْفِعْلَ يَلْزَمُهُ الْكَفَّارَةُ وَهَلْ يَصِيرُ كَافِرًا اخْتَلَفَ الْمَشَايِخُ فيه قال شَمْسُ الْأَئِمَّةِ السَّرَخْسِيُّ رَحِمَهُ اللَّهُ تَعَالَى وَالْمُخْتَارُ لِلْفَتْوَى أَنَّهُ إنْ كان عِنْدَهُ أَنَّهُ يَكْفُرُ مَتَى أتى بهذا الشَّرْطِ وَمَعَ هذا أتى يَصِيرُ كَافِرًا لِرِضَاهُ بِالْكُفْرِ وَكَفَّارَتُهُ أَنْ يَقُول لَا إلَهَ إلَّا اللَّهَ مُحَمَّدٌ رسول اللَّهِ وَإِنْ كان عِنْدَهُ أَنَّهُ إذَا أتى بهذا الشَّرْطِ لَا يَصِيرُ كَافِرًا لَا يَكْفُرُ وَهَذَا إذَا حَلَفَ بِهَذِهِ الْأَلْفَاظِ على أَمْرٍ في الْمُسْتَقْبَلِ أَمَّا إذَا حَلَفَ بِهَذِهِ الْأَلْفَاظِ على أَمْرٍ في الْمَاضِي بِأَنْ قال هو يَهُودِيٌّ أو نَصْرَانِيٌّ أو مَجُوسِيٌّ إنْ كان فَعَلَ كَذَا أَمْسِ وهو يَعْلَمُ أَنَّهُ قد كان لَا شَكَّ أَنَّهُ لَا يَلْزَمُهُ الْكَفَّارَةُ عِنْدَنَا لِأَنَّهُ يَمِينٌ غَمُوسٌ وَهَلْ يَصِيرُ كَافِرًا اخْتَلَفَ الْمَشَايِخُ فيه قال شَمْسُ الْأَئِمَّةِ السَّرَخْسِيُّ رَحِمَهُ اللَّهُ تَعَالَى وَالْمُخْتَارُ لِلْفَتْوَى أَنَّهُ كان عِنْدَهُ أَنَّ هذا يَمِينٌ وَلَا يَكْفُرُ مَتَى حَلَفَ بِهِ لَا يَكْفُرُ وَإِنْ كان عِنْدَهُ أَنَّهُ يَكْفُرُ مَتَى حَلَفَ بِهِ يَكْفُرُ لِرِضَاهُ بِالْكُفْرِ
