Question:
“Assalamualaikum Warahmatullahi Wabarakatuh.
I humbly seek the esteemed guidance of scholars and jurists regarding my situation. my new husband resides in another country. To facilitate my marriage, I appointed a Wakeel on phone call for my Nikah who resides in the same country as my husband and is also his friend. I granted this Wakeel for my Nikah the authority to conduct my Nikah with Abdul Sattar, and I made it clear that my intention was for the Nikah to be performed in accordance with the Hanafi school of thought. The Wakeel carried out the Nikah in the presence of two witnesses. I kindly request your esteemed opinion on whether, in light of Hanafi jurisprudence, this method of appointing a Wakeel for my Nikah and having the Nikah performed in the presence of two witnesses is valid.
Answer:
In the Name of Allah, the Most Gracious, the Most Merciful.
Yes, it is permissible for a woman to appoint a Wakeel over the phone to perform the Nikaah on her behalf who would do it according to the requirements of the Shari’ah, i.e. the Wakeel, the husband and two witnesses; four (4) people in total must be physically present when the Nikaah takes place. So after appointing a Wakeel over the phone, if all the other requirements are met, the Nikaah will be valid [i].
