Miswaak derived from Licorice Roots.

Question:

There is a company by the name of Feydar in USA which manufactures Miswaak derived from Licorice Roots.

Does the usage of such miswaak fulfil the Sunnah act of siwaak?

Is it permissible to use this miswaak while fasting?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Answer:

Siwaak means cleansing the teeth and mouth with a miswaak. The usage of the miswaak is an emphasized practice of The Holy Prophet ﷺ .It is an act of great merit and earns the pleasure of Allah Ta’ala. The Messenger of Allah ﷺ said:    السواك مطهرة للفم مرضاة للرب

“Using miswaak cleanses the mouth and pleases the Lord”

The Miswaak can be obtain from any type of tree as long as it cleansing, soft and gentle i.e. it does not cause injury to the mouth. Although the best miswaak are those sticks which come from the roots of the Araak Tree (Salvadora Persica) because Abdullah bin Masood (may Allah be pleased with him) reported that he used to gather miswaak sticks from the Araak Tree for The Messenger of Allah ﷺ .[1]

However if not available, any twig with the aforementioned conditions will suffice and earn the same rewards, Inshaa Allah. [2] Therefore the miswaak sticks derived from Licorice Roots (Glycyrrhiza Glabra), will be permissible[3] to use and will suffice and fulfil the Sunnah act siwaak.

With regards to the usage of miswaak during while fasting, it was the general practice of the Messenger of Allah ﷺ, whether it be the beginning portion of the day, middle portion or the latter portion.[4]

With the usage of a natural miswaak, if its substance is swallowed, the fast will not be nullified[5].

NB: If one chews on a fresh miswaak stick while fasting, he is not allowed to swallow its substance, he must spit it out, and thereafter there is no harm if he swallows his saliva even though the taste may remain in his mouth. Also if the bristles of the miswaak falls in his mouth, he must spit it out. Similarly is the case of rinsing ones mouth i.e. he must spit out the water, then whatever remains afterwards can be swallowed with the saliva.[6]

As for those miswaak in which flavors are added to it (e.g. clove, lime, mint, etc.) if its substance is swallowed, the fast will be nullified, even though it was done accidentally.

With regards to the Miswaak manufactured by The Feydar Company which uses the Licorice Roots, based on our investigation, all of their miswaak has an added flavor.[7] Therefore, one should refrain from its usage during the hours of fasting and such is the ruling of all flavored Miswaak.

السواك ينبغي أن يكون من أشجار مرة؛ لأنه يطيب نكهة الفم، ويشد الأسنان، ويقوي المعدة، وليكن رطبًا في غلظ الخنصر، وطول الشبرهـ الفتاوى الهندية (1/8)

(قوله: ولا سواك) بل يسن للصائم كغيره صرح به في النهاية لعموم قوله – صلى الله عليه وسلم – «لولا أن أشق على أمتي لأمرتهم بالسواك عند كل وضوء وعند كل صلاة» لتناوله الظهر والعصر والمغرب وقد تقدم أحكامه في الطهارة بحر (قوله: ولو عشيا) أي بعد الزوال هـ

أما الرطب الأخضر فلا بأس به اتفاقا كذا في الخلاصة نهر هـ

وقوله (ولا بأس بالسواك الرطب بالغداة والعشي) ذكره محمد في الأصل أنه لا بأس للصائم يستاك بالسواك الرطب، ولم يذكر أن رطوبته بالماء أو بالرطوبة الأصلية التي تكون للأشجار، ولا ذكر أنه بله بريقه أو بالماء، وذكر في الجامع الصغير لا بأس بالسواك الرطب بالماء للصائم في الفريضة فكان تفسيرا لما ذكر في الأصل ويدل على الرطب بالرطوبة الأصلية بالإلحاق، ولهذا قال المصنف: ولا فرق بين الرطب الأخضر وبين المبلول بالماء، لقوله – صلى الله عليه وسلم – «خير خلال الصائم السواك» من غير فصل بين الرطبين وبين الغداة والعشي هـ

 

يقول العبد الضعيف فيه جواز استعمال الرطوبة الاصلية أو رطوبته بالماء و ادخال هذه الرطوبة في فم الصائم و عدم كراهتها لعموم قوله صلى الله عليه و سلم, و لا يفهم منه ان ابتلاع الرطوبة الاصلية لا يفسد الصوم كما انه لا يقال أن ابتلاع الماء من المضمضة قبل ان يلفظه غير مفسد للصوم.!!
