It it permissible to cook Christmas seasonal foods, selling such items?

Question:

Is it haraam/shirk to participate in activities during the christmas season to
1) cook seasonal food in a halaal manner (sorrel, turkey, non alcoholic fruit cake etc)  and inviting your family to eat.
2) buy/sell gifts and toys as a business as well as profitting from the sale of halaal items like fruit cake.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As Muslims, we should be mindful of deeds and actions that go contrary to the Shari’ah of Islam. Christmas is a festival where the birth of Jesus is celebrated and he is said to be the “son of God.” We ask Allah ﷻ to protect us from adopting such a belief.

A salient characteristic in the life of a Muslim is their intention. So much so, Rasulullah ﷺ said: “Actions are based upon intention and every person will get (the recompense) for that which he intended[i].”He also said in another Hadith, “whoever imitates a people is one of them.[ii]” This means that he will be classed as being from that group of people. So our deeds, thoughts and actions are very important as Muslims.

As for your questions, firstly, Halal food prepared in a Halal manner will be Halal to consume in normal circumstances. However, if Halal food is prepared and eaten in a manner which is done to solely imitate the non-Muslims, especially in their religious practices, then such Halal food will be reprehensible to consume.

That being said, “Christmas” time is usually a time when people are off from work and are at home, so families (Muslims and non-Muslims) get together at that time to eat and socialise. If a Muslim wants to invite non-Muslim family members at that time to eat then they should prepare halal “non-seasonal” food. The halal “seasonal food” can be prepared any other time before or after Christmas for family events. The same ruling will apply if Muslims alone decide to prepare halal “seasonal foods” at that time[iii].

Secondly, it is permissible for Muslims to take advantage of the sale of Halal items at these times provided that the things that they buy are things which they genuinely need and have use for. It will also be permissible for Muslim business owners to stock up on Halal items for that time knowing that it is a time when the sales will increase. However, it will not be permissible for Muslim businessmen and traders to buy and sell Christmas themed items, products and decorations. 

A Muslim should try their best to encourage people to worship Allah ﷻ alone and leave off ascribing partners to Him. He should not be assisting and facilitating the disobedience and the worship of others besides Allah ﷻ.

1 – حدثنا الحميدي عبد الله بن الزبير، قال: حدثنا سفيان، قال: حدثنا يحيى بن سعيد الأنصاري، قال: أخبرني محمد بن إبراهيم التيمي، أنه سمع علقمة بن وقاص الليثي، يقول: سمعت عمر بن الخطاب رضي الله عنه على المنبر قال: سمعت رسول الله صلى الله عليه وسلم يقول: «إنما الأعمال بالنيات، وإنما لكل امرئ ما نوى، فمن كانت هجرته إلى دنيا يصيبها، أو إلى امرأة ينكحها، فهجرته إلى ما هاجر إليه»

والإعطاء باسم النيروز والمهرجان لا يجوز، وقال صاحب الجامع الأصغر: إذا أهدى يوم النيروز إلى مسلم آخر ولم يرد به تعظيم ذلك اليوم ولكن جرى على ما اعتاده بعض الناس لا يكفر ولكن ينبغي له أن لا يفعل ذلك اليوم خاصة ويفعله قبله أو بعده كي لا يكون تشبها بأولئك القوم.

(والإعطاء باسم النيروز والمهرجان لا يجوز) أي الهدايا باسم هذين اليومين حرام (وإن قصد تعظيمه) كما يعظمه المشركون (يكفر) قال أبو حفص الكبير: لو أن رجلا عبد الله خمسين سنة ثم أهدى لمشرك يوم النيروز بيضة يريد تعظيم اليوم فقد كفر وحبط عمله اهـ ولو أهدى لمسلم ولم يرد تعظيم اليوم بل جرى على عادة الناس لا يكفر وينبغي أن يفعله قبله أو بعده نفيا للشبهة ولو شرى فيه ما لم يشتره قبل إن أراد تعظيمه كفر وإن أراد الأكل كالشرب والتنعيم لا يكفر زيلعي

(قوله والإعطاء باسم النيروز والمهرجان) بأن يقال هدية هذا اليوم ومثل القول النية فيما يظهر ط والنيروز أول الربيع والمهرجان أول الخريف وهما يومان يعظمهما بعض الكفرة ويتهادون فيهما (قوله ثم أهدى لمشرك إلخ) قال في جامع الفصولين: وهذا بخلاف ما لو اتخذ مجوسي دعوة لحلق رأس ولده فحضر مسلم دعوته فأهدى إليه شيئا لا يكفر، وحكي أن واحدا من مجوسي سربل كان كثير المال حسن التعهد بالمسلمين، فاتخذ دعوة لحلق رأس ولده، فشهد دعوته كثير من المسلمين، وأهدى بعضهم إليه فشق ذلك على مفتيهم، فكتب إلى أستاذه علي السعدي أن أدرك أهل بلدك، فقد ارتدوا وشهدوا شعار المجوسي وقص عليه القصة فكتب إليه إن إجابة دعوة أهل الذمة مطلقة في الشرع ومجازاة الإحسان من المروءة وحلق الرأس ليس من شعار أهل الضلالة والحكم بردة المسلم بهذا القدر لا يمكن والأولى للمسلمين أن لا يوافقوهم على مثل هذه الأحوال لإظهار الفرح والسرور اهـ (قوله والتنعيم) عبارة الزيلعي والتنعم بتشديد العين
