Is one’s ex-mother-in-law Mahram?

Question:

 A person got married then divorced his wife before consummating the marriage, Can he accompany his ex-mother-in-law on a journey to the United States?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

When a man contracts a marriage he becomes a “mahram” (one with whom marriage is permanently prohibited) to the mother of his wife at that very instant, regardless if the marriage was consummated or not. [1]

Allah ﷻ mentions in the Holy Quran وأمهات نسائكم

“Prohibited for you in marriage are the mothers of your wives“. {An-nisa Ayah 23}

This “hurma” (prohibition) is permanent and will continue even after the marriage has terminated either by divorce or death. Sayyiduna Ibn Abbaas (may Allah be pleased with him) said:

اذا طلق الرجل المراة قبل ان يدخل بها أو ماتت لم تحل له أمها وراه ابن أبي حاتم

“If a man divorces his wife or she dies, before consummating the marriage her mother is prohibited for him (in marriage)“ [2]

Hafidh Ibn Kathir has mentioned in his Tafseer that such view is in accordance to the four illustrious Imams of Islamic Jurisprudence.[3]

Therefore it would be permissible for him to accompany his ex-mother-in-law on her journey to the United States provided that there is no fear of fitnah, temptation or desire.

[1] أحكام القرآن للجصاص ط العلمية (2/ 161)

فلما كان في حكم الدخول في باب استحقاق كمال المهر ووجوب العدة جعله كذلك في حكم التحريم. والدليل على أن أمهات النساء يحرمن بالعقد قوله تعالى: {وأمهات نسائكم} هي مبهمة عامة كقوله: {وحلائل أبنائكم} وقوله: {ولا تنكحوا ما نكح آباؤكم من النساء} , فغير جائز تخصيصه إلا بدلالة.

 

الرد المحتار قوله (مصاهرة) كفروع نسائه المدخول بهن وإن نزلن وأمهات الزوجات وجداتهن بعقد صحيح ، وإن علون ، وإن لم يدخل بالزوجات. َص 99 ج 4 مكتبة امدادية

حدثنا جعفر بن محمد بن هارون بن عزرة، ثنا عبد الوهاب، عن سعيد، عن قتادة، عن عكرمة، عن ابن عباس أنه كان يقول: إذا طلق الرجل امرأة قبل أن يدخل بها أو ماتت، لم تحل له أمها، أنه قال: مبهمة، فكرهها- وروي عن ابن مسعود، وعمران بن حصين، ومسروق، وطاوس، وعكرمة، وعطاء، والحسن، ومكحول، وابن سيرين، وقتادة، والزهري نحو ذلك

بخلاف الأم فإنها تحرم بمجرد العقد على الربيبة])

قال ابن أبي حاتم: حدثنا جعفر بن محمد بن هارون بن عزرة حدثنا عبد الوهاب، عن سعيد، عن قتادة، عن عكرمة، عن ابن عباس: أنه كان يقول إذا طلق الرجل امرأة قبل أن يدخل بها أو ماتت لم تحل له أمها، أنه قال: إنها مبهمة، فكرهها ثم قال: وروي عن ابن مسعود، وعمران بن حصين، ومسروق، وطاوس، وعكرمة، وعطاء، والحسن، ومكحول، وابن سيرين، وقتادة، والزهري نحو ذلك. وهذا مذهب الأئمة الأربعة والفقهاء السبعة، وجمهور الفقهاء قديما وحديثا، ولله الحمد والمنة هـ
