Hajj queries. Performing Rami (Stoning of Jamarat) before Zawal and reciting the Talbiyah.

Question:

Assalamualaikum wa rahmatullahi wa brakatahu,
Respected Mufti,
I have following 2 Queries:

1) Whether Hajj Pilgrims could do Rami (Stoning of Jamarat) on Ayyam Tashriq (that is 11th and 12th of Zilhajj) BEFORE ZAWAL, under desirable Circumstances? Is it permissible?

2) If any of the HAJJ Pilgrims, does not utter TALBIYAH, at all, throughout the performance of Hajj , after putting on Ahram, is his Hajj Acceptable?
    Because in our group some of our friends committed the above mistake, this year.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

1)The time of Ramy (stoning the Jamraat) on 11th and 12th Dhul Hijjah begins from after Zawāl (the beginning time of Zuhr) and remains until Subh Sadiq (before faji time enters)[1].

 Therefore, if Ramy was done before Zawāl on 11th Dhul Hijjah and was not repeated after Zawaal, then a Damm (sacrifice of a goat or equivalent within Haram) is necessary. Ramy on the 10th of Thul Hijjah can be done before Zawaal.

2) In order for entering into the state of Ihraam to be valid, the following two conditions must be fulfilled:

a)    One must make an intention (niyyah), whether verbal or non-verbal of entering into Ihraam for an Ibadaah.

b)    Recitation of the Talbiyah (Labbayk Allahumma labbayk…) or any other form of remembrance that venerates Allah Ta’ala, irrespective of whether this is in the Arabic language or another language. E.g. ‘Allahu Akbar’ or any similar Zikr.[2] If such Zikr was done, then Ihraam for Hajj will be valid.

وَأَمَّا وَقْتُ الرَّمْيِ في الْيَوْمِ الثَّانِي وَالثَّالِثِ فَهُوَ ما بَعْدَ الزَّوَالِ إلَى طُلُوعِ الشَّمْسِ من الْغَدِ حتى لَا يَجُوزَ الرَّمْيُ فِيهِمَا قبل الزَّوَالِ إلَّا أَنَّ ما بَعْدَ الزَّوَالِ إلَى غُرُوبِ الشَّمْسِ وَقْتٌ مَسْنُونٌ وما بَعْدَ الْغُرُوبِ إلَى طُلُوعِ الْفَجْرِ وَقْتٌ مَكْرُوهٌ هَكَذَا رُوِيَ في ظَاهِرِ الرِّوَايَةِ

أما بيان ما يصير به محرما فنقول وبالله التوفيق لا خلاف في أنه إذا نوى وقرن النية بقول أو فعل هو من خصائص الإحرام أو دلائله – أنه يصير محرما بأن لبى ناويا به الحج إن أراد به الإفراد بالحج أو العمرة إن أراد الإفراد بالعمرة أو العمرة والحج إن أراد القران لأن التلبية من خصائص الإحرام
