Is 3 divorces in the state of intoxication valid?

Question

If a man says to his wife over phone divorce 3 times intoxicated and extremely angry, is the divorce valid? Can they salvage the marriage?

Answer

بسم الله الرحمن الرحيم

Based on what has been stated in the query, it is clear that the three divorces pronounced are valid. Consequently, the marriage is terminated and thus, it is impossible for the ex-husband to revoke the divorce as it is irrevocable. It is also impermissible for him to re-marry his irrevocably divorced wife (whether within, or after her iddah period).

Furthermore, this condition (irrevocable impermissibility) is perpetuated until the ex-wife (any time after the completion of her iddah period) marries another man, consummates the marriage with him and thereafter, if the man (second husband) happens to divorce her or dies, thereafter, upon the completion of her Iddah, she will be able to re-marry her first husband.

Nb: This process is termed Halalah i.e. where the ex-wife naturally becomes Halal (lawful in marriage) for her first ex-husband. This cannot be planned and orchestrated. Rather it should occur naturally.

Nb: The Jurists have stated that divorce pronounced in the state of intoxication is valid.[1] Also, divorce pronounced in the state of anger is valid and takes effect.[2]

وأما من شرب من الأشربة المتخذة من الحبوب والعسل فسكر وطلق لا يقع عند أبي حنيفة وأبي يوسف خلافا لمحمد ويفتى بقول محمد؛ لأن السكر من كل شراب محرم اهـ. وقال قاضيخان في فتاويه: أما إذا شربه مكرها وسكر اختلفوا فيه والأصح أنه لا يقع كما لا يحد اهـ. وقال الأتقاني قال في التحفة المكره على شرب الخمر أو المضطر إذا شرب فسكر فإن طلاقه لا يقع فإن هذا ليس بمعصية، ثم قال وبعض المشايخ قالوا يقع وفي الإيضاح يقع؛ لأن الزوال حصل بفعل هو محظور في الأصل والأول هو الصحيح اهـ.

قال قاضي خان في فتاويه في طلاق من لا يعقل: ولو أكره على شرب الخمر أو شرب الخمر لضرورة وسكر فطلق اختلفوا فيه والصحيح أنه كما لا يلزمه الحد لا يقع طلاقه ولا ينفذ تصرفه اهـ. (قوله: ولو زال بالبنج) قال قاضي خان في فتاويه: ومن زال عقله بالبنج ولبن الرماك لا ينفذ طلاقه وعتاقه اهـ. قال في باب حد الشرب من النهاية: الفتوى في زماننا على أن من سكر من البنج يقع طلاقه ويحد شاربه لفشو هذا الفعل فيما بين الناس، وكذا قال في المحيط اهـ

[2] The Jurists have stated that if a person pronounces divorce in the state of anger (or extreme anger), except that he is mentally sound and he is fully aware of what he is saying and perusing then there is no doubt that divorce occurs. The only concession mentioned by the Jurists is that of a person who became extremely angry to the extent that he was unaware of what he was saying (ie he reaches the state of insanity, which is very rare)

مطلب في طلاق المدهوش وقال في الخيرية: غلط من فسره هنا بالتحير، إذ لا يلزم من التحير وهو التردد في الأمر ذهاب العقل. وسئل نظما فيمن طلق زوجته ثلاثا في مجلس القاضي وهو مغتاظ مدهوش، أجاب نظما أيضا بأن الدهش من أقسام الجنون فلا يقع، وإذا كان يعتاده بأن عرف منه الدهش مرة يصدق بلا برهان. اهـ. قلت: وللحافظ ابن القيم الحنبلي رسالة في طلاق الغضبان قال فيها: إنه على ثلاثة أقسام: أحدها أن يحصل له مبادئ الغضب بحيث لا يتغير عقله ويعلم ما يقول ويقصده، وهذا لا إشكال فيه. والثاني أن يبلغ النهاية فلا يعلم ما يقول ولا يريده، فهذا لا ريب أنه لا ينفذ شيء من أقواله
