Is it permissible for me to discard Islamic Literature by burning it?<\/span><\/p>\n

Answer:<\/span><\/p>\n

Literature in which the name of Allah\ufdfb, His attributes, Qur\u2019aanic Verses, names of the Prophets etc. must be treated with utmost respect because of its contents. If there is a need to discard such literature then it must be done in a manner that is not disrespectful and degrading for it is totally prohibited and if done so deliberately is tantamount to Kufr.<\/span><\/p>\n

After agreeing on the above, the Islamic Jurists have differed as to what is the best method of disposing such literature. According to the Hanafi Madhab, the most preferred method is by burying it as this is regarded as Ikraam and Ta\u2019dhim (honor and reverence). It must be noted however, that according to the Madhab, merely digging a hole and burying the literature is not sufficient as throwing dirt upon it is also regarded disrespectful and abasing. For the method of burial the Hanafi Jurists have placed three conditions that must be met viz.[1]<\/a><\/span><\/p>\n

(1) A Lahad type of grave should be dug and the literature placed in the niche, then the niche sealed with bricks or wood thereafter dirt of thrown to cover the hole.<\/span><\/p>\n

(2) It should be wrapped in a clean piece of cloth before being placed in the niche.<\/span><\/p>\n

(3) It should be buried in a piece of land where no one walks upon.<\/span><\/p>\n

As showed above, the Jurists only regard burying as being the most sacred method if these three conditions are met. However, because of the great difficulty in fulfilling these conditions, especially if the quantity of literature is large, as in the case of Islamic Institutes and Publishers. Therefore one may resort to other methods of disposing such literature without any form of disrespect.<\/span><\/p>\n

The Jurists have also stated that washing the books\/pages in flowing water (e.g. sea, river etc.) is also permissible. This method was adopted earlier on because the inks were soluble and would dissolve easily in the water. However, in our times the ink used for printing\/ writing is insoluble, hence it would not be permissible to place\/throw Islamic literature into the seas and rivers as it is regarded as disrespectful degrading.<\/span><\/p>\n

The Jurists have also stated that it is permissible to burn the literature except that this method of discarding is disliked by the Majority of the Hanafi Jurists who prefer burying or washing. However, due to the great difficulty associated with adopting these two methods one may resort to burning with the intention of reverence and respect. In fact it is proven that Uthman bin Afaan (r.a.), after gathering the Quran in one Mushaf, he ordered that all other copies of the Quran be burnt.<\/span><\/p>\n

Imaam Al-Bukhari confirms this incident in his Sahih under the Chapter- \u201cThe collection of the Qur’an\u201d (\u0628\u0627\u0628 \u062c\u0645\u0639 \u0627\u0644\u0642\u0631\u0622\u0646).[2]<\/a> Al-Hafidh Ibn Hajr and Al-Imaam Badrudin al-Ayni on their commentaries of Sahih al-Bukhari also state that; Mus\u2019ab bin Sa\u2019d bin Abi Waqaas (r.a)[3]<\/a> said that he met numerous people (Sahabah) at the time when Uthman (r.a) ordered the burning of the extra Masaahif and not none of them objected.[4]<\/a><\/span><\/p>\n

Ibn al-Batal states in his commentary of Sahih al-Bukhari that; the action of Uthman (r.a) i.e. burning of the extra Masaahif, shows the permissibility of discarding Islamic literature in which the name of Allah \ufdfb is written, as this is regarded as revering and honoring its contents and also protecting it from being trampled upon (in the case of washing) and casting it away into the earth.[5]<\/a><\/span><\/p>\n

Mulla Ali Al-Qaari (r.a) states in his commentary of Mishkaat \u2013al Masaabih that what Uthmaan (r.a.) burnt was not regarded as the Quran i.e. it was not from the verses of the Quran.[6]<\/a> Al- Imaam Badrudin al-Ayni, in is commentary of Sahih al-Bukhari quotes Allaamah al-Kirmani as having similar views, he then refuted such a claim by stating that; such a statement can only be from one who is not acquainted with the works of the Scholars and has not contemplated on the last part of the Hadith[7]<\/a> i.e.<\/span><\/p>\n

In conclusion, it would be better to discard Islamic literature by burying providing that the aforementioned conditions are met. However, if there is difficulty in fulfilling these conditions then burning it (with the intention of honoring and revering its contents) would be permissible without any Karahah (dislike).<\/span><\/p>\n
