If a non-Muslim parents stipulate in their will that some of their money\/property\/jewelry be given to their Muslim child after their death, would it be permissible for the Muslim child to accept that inheritance?<\/span><\/p>\n

A Muslim cannot inherit from a disbeliever, nor can a disbeliever inherit from a Muslim. [1]<\/strong><\/a><\/em><\/span><\/p>\n

Differences in religion is a factor that will prevent a person inheriting from the other.[2]<\/a> The hadith is specific to inheritance and does not apply to Wasiya (will).It is permissible for a Muslim to make a will to a non-Muslim and similarly, it is permissible for a non-Muslim to make a Wasiyya for a Muslim.[3]<\/a><\/span><\/p>\n

Saeed bin Mansoor reports in his Sunan that Safiya bint Huyai (wife of the Holy Prophet \ufdfa) sold her house to Muawiyah bin Abi-Sufyan for one hundred thousand dirhams. Safiya had a brother who was a Jew, she encouraged him to accept Islam so that he can legally inherit from her estate after her demise. He however refused to accept Islam. Safiya then made a Wasiya to him from one third of the hundred thousand. [4]<\/a> This narration shows the permissibility of making will\/bequest to a non-Muslim and moreover it indicates the permissibility of a Muslim being able to receive from the will of a non- Muslim.[5]<\/a><\/span><\/p>\n

When a person dies there are four rights\/claims connected to his estate; (1) Burial Expenses (2) Debts (3) Will\/ Wasiyya (4) Inheritance. This shows that a wasiya\/will is different from the actual inheritance. It only resembles inheritance in that it comes into effect after the death of the testator but its rulings are different to that of inheritance.[6]<\/a><\/span><\/p>\n

Given to the fact that your parents are presently non-Muslims and if they were to die in that condition, you would not be able to inherit from either of them because of the differences in religion as stated in the aforementioned hadith. However you would be a valid legatee (benefactor) if they made a will to your name since you are not considered a legal heir.[7]<\/a>. The Holy Prophet \ufdfa said; \u0644\u0627 \u0648\u0635\u064a\u0629 \u0644\u0648\u0627\u0631\u062b<\/strong><\/span><\/p>\n

There is no wasiya (i.e. it is not valid) to a legal heir.[8]<\/strong><\/a> <\/em><\/span><\/p>\n

Therefore, the money\/property that you would receive in the event of your parent\/parents passing away would be considered a gift and not inheritance and would thus be permissible.<\/span><\/p>\n

NB<\/strong>: You should continue encouraging your parents to enter and accept the religion of Islam, the true and accepted religion by Allah \ufdfb.<\/span><\/p>\n
