The boy&#8217;s friend acted as the officiant  and his friends were the witnesses. There is no written proof of this marriage, and the dowry was verbally agreed upon without any written document, and the boy didn\u2019t give any money. At that time, we were both 18 years old.<br>In this case, is the marriage valid? I cannot live with this boy anymore, and no one in the family knows about this. It\u2019s not possible to inform them.&#8221;<\/p>\n\n\n\n<p><strong>Answer:<\/strong><\/p>\n\n\n\n<p><strong>In the Name of Allah, the Most Gracious, the Most Merciful.<\/strong><\/p>\n\n\n\n<p>It is permissible for a woman to appoint a Wakeel over the phone to perform the Nikaah on her behalf who would do it according to the requirements of the Shari\u2019ah, i.e. the Wakeel, the husband and two witnesses; four (4) people in total must be physically present when the Nikaah takes place. Therefore after appointing a Wakeel over the phone, if all the other requirements are met, the Nikaah will be valid. It is unclear from your query if you appointed anyone as your wakeel, who was physically present at the boy\u2019s presence<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a>.<\/p>\n\n\n\n<p>As far as the other conditions, in principle Nikah will only be valid if;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Ijaab and Qabool (proposal and acceptance) was done in the same sitting.<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a><\/li>\n\n\n\n<li>In the presence of at least two male witnesses or one male witness and two female.<\/li>\n\n\n\n<li>The two witnesses hear and understand the proposal and acceptance together at the same time<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a>.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>You would have to apply your mind and fear Allah and decide whether the above-mentioned conditions were found in the mentioned situation.<\/p>\n\n\n\n<p>As far as performing the Nikaah without the parents knowledge, in normal circumstances a woman should seek consent of her wali (father\/guardian) when choosing a spouse, before conducting the Nikaah. If however, consent was <strong>not<\/strong> sought then two scenarios can exist and their rulings are as follows: (a) If the girl marries someone who is not suitable\/compatible (a non-equal in Shariah\/Islam) then the marriage will not be contracted i.e. the marriage will not be valid.
