Question:<\/strong><\/p>\n\n\n\n

Can wife get annulment if the husband hasn’t had any intimacy with her since 4 months and more. How can she maintain her Chasity if she can’t get a divorce.<\/p>\n\n\n\n

Answer:<\/strong><\/p>\n\n\n\n

In the Name of Allah, the Most Gracious, the Most Merciful.<\/strong><\/p>\n\n\n\n

It is quite unusual for a man to stay away from conjugal relations with his wife for four months under normal living circumstances. If there is nothing preventing the husband from fulfilling his wife\u2019s conjugal rights, whether it is distance or otherwise, then the couple should get counselling to find out the reason for the husband\u2019s abstinence from his wife. Divorce or annulment of a marriage is always the final resort in Islam after having exhausted all other forms of reconciliation between the couple.<\/p>\n\n\n\n

Nevertheless, as long as the man did not make an oath to stay away from conjugal relations with his wife for four months whether it was explicit or implicit words, his failure to be intimate with his wife for four months or more will not affect the validity of his marriage. Therefore, the wife cannot get a divorce from her husband by him merely staying away from her for four months. However, it is not permissible for man to stay away from intimacy with his wife for more than four months without her consent[i]<\/sup><\/a>. (See also: Ahsaanul Fatawaa Vol. 5 pg. 373)<\/p>\n\n\n\n

The wife should explain to the her husband how she feels and if the husband fails to fulfil her rights, then she should get the Imaam or some other\u00a0 respectable elder in the community to speak to him so that he can change his ways. After that, if the husband still does not want to fulfil his wife\u2019s conjugal rights then she may ask him for a divorce, if he does not want to issue a divorce, then she may ask him for Khul\u2019ah which is paying back a portion of her mahr\/dowry to her husband for him to issue a divorce to her[ii]<\/sup><\/a>.<\/p>\n\n\n\n

Finally, if the husband does not want to do any of the above, then the wife should go to a Qaadhi\/Muslim judge, a proper Shari\u2019ah board (established to deal with such issues) or a Darul Iftaa to ask for an annulment of the marriage[iii]<\/sup><\/a>.<\/p>\n\n\n\n
