Question:<\/strong><\/p>\n\n\n\n

Asalaamu walaikum,<\/p>\n\n\n\n

I need the air clear on a few\nthings for fear of fitnah and misguidance InShaaAllah.<\/p>\n\n\n\n

1. Is Cannabis considered to\nbe an intoxicant?<\/p>\n\n\n\n

If so, does it has the\ncharacteristics of an intoxicating substance?<\/p>\n\n\n\n

2.What are the medical\npermissibility of using this herb, as it has been proven to aid depression,\nanxiety, and many other ailments.<\/p>\n\n\n\n

Please clarify for me\ninShaaAllah.<\/p>\n\n\n\n

Answer:<\/strong><\/p>\n\n\n\n

In the Name of Allah, the Most Gracious, the Most Merciful.<\/strong><\/p>\n\n\n\n

As-sal\u0101mu \u2018alaykum wa-rahmatull\u0101hi wa-barak\u0101tuh.<\/strong><\/p>\n\n\n\n

Shari\u2019ah prohibits any\nsubstance which causes intoxication. This ruling is derived from the following\nAhadith:<\/p>\n\n\n\n

\u0643\u064f\u0644\u064f\u0651 \u0645\u064f\u0633\u0652\u0643\u0650\u0631\u064d \u062d\u064e\u0631\u064e\u0627\u0645\u064c<\/p>\n\n\n\n

Abu Musa al-Ash\u2019ari\n(Radhiyallahu Anhu) narrates that Rasulullah (\ufdfa<\/strong>) said:\n“All intoxicants are prohibited.”(Bukhari & Muslim)<\/p>\n\n\n\n

\u200f<\/strong> \u0645\u064e\u0627 \u0623\u064e\u0633\u0652\u0643\u064e\u0631\u064e\n\u0643\u064e\u062b\u0650\u064a\u0631\u064f\u0647\u064f \u0641\u064e\u0642\u064e\u0644\u0650\u064a\u0644\u064f\u0647\u064f \u062d\u064e\u0631\u064e\u0627\u0645\u064c \u200f“<\/strong>\u200f<\/p>\n\n\n\n

The Prophet (\ufdfa<\/strong>)\nsaid: If a large amount of anything causes intoxication, a small amount of it\nis prohibited.(Abu Dawood)<\/p>\n\n\n\n

It is clear that marijuana due to its\nmind-altering effects is an intoxicant and is impermissible, even if used in\nsmall amounts. There is overwhelming scientific evidence that marijuana\nintoxicates and even the physical effects that can be seen in the behaviour of\na person who has smoked marijuana leaves no doubt of the intoxicating effects\nof this drug.<\/p>\n\n\n\n

Furthermore, Shari\u2019ah\nprohibits harming oneself. Allah Ta\u2019ala says in the Quraan,<\/p>\n\n\n\n

\u0648\u0644\u0627 \u062a\u0644\u0642\u0648\u0627\n\u0628\u0623\u064a\u062f\u064a\u0643\u0645 \u0625\u0644\u0649 \u0627\u0644\u062a\u0647\u0644\u0643\u0629<\/p>\n\n\n\n

 <\/strong>\u2018And do not throw yourself into destruction.\u2019 (Surah\nal-Baqarah \u2013: 195)<\/p>\n\n\n\n

Therefore the prohibition of\ncannabis\/marijuana is clear according to the rulings of Shari\u2019ah. Thus, the\nsmoking or consumption of any sort of the common and readily available forms of\nmarijuana, synthetic, imitation cannabis is prohibited due to it being an\nintoxicant. The ruling of prohibition will remain even if marijuana becomes\nlegal in a country. <\/p>\n\n\n\n

With regards to the medical\nuse of Marijuana, one must firstly resort to the use of Halaal alternative\nmedications.  Also it is highly unlikely\na reliable doctor will prescribe such forms of medications in a country where\nmarijuana is illegal. In a case of necessity where other\nmedications are unsuccessful, one may take aid from this drug in such forms\nthat have zero levels of intoxication (High-CBD and very low to zero levels of THC), only through ingestion or\napplication and not through smoking.<\/p>\n\n\n\n
