{"id":111,"date":"2014-10-06T17:38:22","date_gmt":"2014-10-06T17:38:22","guid":{"rendered":"http:\/\/fatwa-tt.com\/?p=111"},"modified":"2017-11-09T00:19:18","modified_gmt":"2017-11-09T04:19:18","slug":"using-someone-elses-wi-fi-birthdays-digital-pictures","status":"publish","type":"post","link":"https:\/\/fatwa-tt.com\/index.php\/using-someone-elses-wi-fi-birthdays-digital-pictures\/","title":{"rendered":"Using someone else\u2019s Wi-Fi, Birthdays, digital pictures."},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Question:<\/strong><\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"color: #000000;\">Is it permissible to use someone else&#8217;s wifi if they haven&#8217;t put a password?(of neighbours, adjacent offices, etc) there are some places where there is an availability of such signals like malls, restaurants, etc.<\/span><\/li>\n<li><span style=\"color: #000000;\">can i wish &#8220;happy birthday&#8221; to my friend? can we accept treat from them?<\/span><\/li>\n<li><span style=\"color: #000000;\">is it allowed to have digital pictures? people usually keep capturing photos of friends. when my friends do so, i do not forbade them because i&#8217;ve heard somewhere that its permissible.<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Answer:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>In the Name of Allah, the Most Gracious, the Most Merciful.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>As-sal\u0101mu \u2018alaykum wa-rahmatull\u0101hi wa-barak\u0101tuh.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">1) If the Wi-Fi is meant for public usage, e.g. in some malls and restaurants, then is will be permissible to use.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">However it would not be permissible to use someone\u2019s personal Wi-Fi, e.g. neighbours, without their permission. In many countries, using someone else\u2019s Wi-Fi connection is illegal<a style=\"color: #000000;\" href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>. Moreover, by unlawfully using someone\u2019s Wi-Fi, quite likely some sort of disadvantage will be caused to them. It is enough evil for any man to despise his brother Muslim.<a style=\"color: #000000;\" href=\"#_ftn2\" name=\"_ftnref2\"><sup><strong><sup>[2]<\/sup><\/strong><\/sup><\/a><\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">It is clear from the had\u012bth above that as Muslims, we should always take full caution when dealing with others and using anything that belongs to them, especially if it is without their consent.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">2) As Muslims we are sensitive to our belief of pure <em>Taw<\/em><em>\u1e25<\/em><em>\u012bd<\/em> (Oneness of Allah Ta\u02bf\u0101l\u0101). This requires us to also completely disassociate ourselves from all practices related to Kuffar and their customs.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The Prophet Sallallahu Alaihi Wa Sallam has said:<\/span><\/p>\n<p style=\"text-align: right;\"><span style=\"color: #000000;\">\u0645\u064e\u0646\u0652 \u062a\u064e\u0634\u064e\u0628\u0651\u064e\u0647\u064e \u0628\u0650\u0642\u064e\u0648\u0652\u0645\u064d \u0641\u064e\u0647\u064f\u0648\u064e \u0645\u0650\u0646\u0652\u0647\u064f\u0645\u0652<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u201cWhosoever emulates a nation is amongst them\u201d <em>Sunan Abi Dawud 4\/44<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">The custom of celebrating birthdays is a hallmark of disbelievers and was never prevalent among Muslims. It was brought to them from non-Muslims like other influences during the period of colonialism.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">It is not permissible to celebrate birthdays or offer a gift to a person on his\/her birthday as it is imitating the customs and way of disbelievers.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">It is important to note that the issue is not only about gifts or birthdays. It is a value system which we are diametrically opposed to. Disbelievers focus on their past and their achievements. As muslims our focus is on regretting our past and our shortcomings and preparing for our <em>Aakhira<\/em>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">However, remember that one requires lots of wisdom and diplomacy in correcting a wrong practice especially amongst close friends and associates.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">3) The ruling of digital pictures and videos is a highly contested issue amongst prominent &#8216;Ulama. Many contend that digital pictures and videos are not the same as regular photographical pictures while others are of the opinion that they are in the same ruling as regular pictures, hence impermissible.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">In light of many authentic Ahadith, we advise that one should avoid taking photographs unless it is considered in Shariah to be absolutely necessary.
