Menopausal bleeding clarification.

fatwa-tt November 29, 2016

Question:

asalaamu aliakum. In most fiqh books I read that a woman over 55years who sees blood then it will not be haidh, but in Bahisti zewar I saw that if she sees a dark red or dark brown it will be considered haidh…Please clarify for me if a woman over 55years sees blood discharge what should be done?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The following is mentioned in Bahishti Zewar,

If blood flows after the age of fifty five, it will only be regarded as haid if it is extremely red or black. If it is yellow, green or brown, it is not haid but istihaada. However, if yellow, green or brown blood used to flow from this woman before she turned fifty five, then after the age of fifty five, these colours will also be regarded as haid. But if it happens contrary to her habit, it will not be haid but istihaada.

Hence, in the case of menopausal bleeding after the age of fifty-five lunar years, if a woman experiences absolutely red or black blood, then the bleeding will be regarded as haidh (menstrual period).

 However, if the blood is yellow, green or brown colored, it will not be considered as haidh but istihadhah(chronic discharge), provided she never got this type of blood during her earlier normal periods. If she did get this type of blood during her earlier periods, then this would also be counted as haidh. For e.g. the blood prior to the menopausal-age haidh was brownish, and it is also brownish after the menopausal-age haidh. In such a case, it would be considered haidh.

If the color of the blood is different from that of the blood during her earlier periods, then it will be not haidh but istihadhah.[1]

(قَوْلُهُ: وَانْقَطَعَ دَمُهَا) أَمَّا لَوْ بَلَغَتْهُ وَالدَّمُ يَأْتِيهَا فَلَيْسَتْ بِآيِسَةٍ، وَمَعْنَاهُ: إذَا رَأَتْ الدَّمَ عَلَى الْعَادَةِ؛ لِأَنَّهُ حِينَئِذٍ ظَاهِرٌ فِي أَنَّهُ ذَلِكَ الْمُعْتَادُ، وَعَوْدُ الْعَادَةِ يُبْطِلُ الْإِيَاسَ، ثُمَّ فَسَّرَ بَعْضُهُمْ هَذَا بِأَنْ تَرَاهُ سَائِلًا كَثِيرًا احْتِرَازًا عَمَّا إذَا رَأَتْ بَلَّةً يَسِيرَةً وَنَحْوَهُ، وَقَيَّدُوهُ بِأَنْ يَكُونَ أَحْمَرَ أَوْ أَسْوَدَ، فَلَوْ أَصْفَرَ أَوْ أَخْضَرَ أَوْ تُرَبِيَّةً لَا يَكُونُ حَيْضًا، وَمِنْهُمْ مَنْ لَمْ يَتَصَرَّفْ فِيهِ فَقَالَ: إذَا رَأَتْهُ عَلَى الْعَادَةِ الْجَارِيَةِ وَهُوَ يُفِيدُ أَنَّهَا إذَا كَانَتْ عَادَتُهَا قَبْلَ الْإِيَاسِ أَصْفَرَ فَرَأَتْهُ كَذَلِكَ أَوْ عَلَقًا فَرَأَتْهُ كَذَلِكَ كَانَ حَيْضًا. اهـ.

المحيط البرهاني في الفقه النعماني (1/ 213)

فأما إذا كانت آيسة وحكم بإياسها ثم رأت شيئاً قليلاً يباشر الصفرة لا يكون حيضاً لأن ذلك أثر البول فلا يبطل به حكم الإياس

الجوهرة النيرة (4/ 291)

( قَوْلُهُ وَإِذَا كَانَتْ آيِسَةً فَاعْتَدَّتْ بِالشُّهُورِ ثُمَّ رَأَتْ الدَّمَ انْتَقَضَ مَا مَضَى مِنْ عِدَّتِهَا وَكَانَ عَلَيْهَا أَنْ تَسْتَأْنِفَ الْعِدَّةَ بِالْحَيْضِ ) وَهَذَا عَلَى الرِّوَايَةِ الَّتِي لَمْ يَقْدِرُوا لِلْإِيَاسِ فِيهَا قَدْرًا فَإِنَّهَا إذَا رَأَتْ الدَّمَ عَلَى الْعَادَةِ يَبْطُلُ الْإِيَاسُ وَظَهَرَ أَنَّ مَا مَضَى مِنْ عِدَّتِهَا لَمْ يَكُنْ خَلَفًا وَهُوَ الصَّحِيحُ ؛ لِأَنَّ شَرْطَ الْخَلِيفَةِ تَحَقُّقُ الْإِيَاسِ وَذَلِكَ بِاسْتِدَامَةِ الْعَجْزِ إلَى الْمَمَاتِ أَمَّا عَلَى الرِّوَايَةِ الَّذِي قَدَّرُوا الْإِيَاسَ فِيهَا بِمُدَّةٍ إذَا بَلَغَتْهَا ثُمَّ رَأَتْ الدَّمَ بَعْدَهَا لَمْ يَكُنْ حَيْضًا وَيَكُونُ كَمَا تَرَاهُ الصَّغِيرَةُ الَّتِي لَا تَحِيضُ مِثْلُهَا وَفِي الْمَرْتَبَةِ عَنْ بَعْضِهِمْ أَنَّ مَا تَرَاهُ الْآيِسَةُ حَيْضٌ عَلَى الرِّوَايَاتِ أَجْمَعَ ؛ لِأَنَّ الْحُكْمَ بِالْإِيَاسِ بَعْدَ خَمْسٍ وَخَمْسِينَ سَنَةً بِالِاجْتِهَادِ وَرُؤْيَةُ الدَّمِ نَصٌّ فَيَبْطُلُ بِهِ الِاجْتِهَادُ فَعَلَى هَذَا لَا بُدَّ أَنْ يَكُونَ الدَّمُ أَحْمَرَ عَلَى مَا هُوَ الْعَادَةُ أَمَّا إذَا كَانَ أَصْفَرَ أَوْ أَخْضَرَ لَا يَبْطُلُ الْإِيَاسُ
