Is it permissible to kill an animal with the intention of relieving its pain and suffering?

Question:

Is it permissible to kill a dog which is very sick and close to dying with the intention of relieving its pain and suffering?

Answer:

بسم الله الرحمن الرحيم

According to Hanafi Jurists it is permissible to kill an animal whose meat is not eaten (dogs, donkeys, cats etc.) if it becomes very sick and is close to death as a means of relieving it from its pain and suffering. Alaamah Haskafi (r.a.) mentions that it is preferable to kill/slaughter a dog which has reached such a condition.[1]

Alaamah Ibn Abideen (r.a.) after concurring with Alaamah Haskafi states that, such an act is commendable as it reduces or removes its pain.[2]

It is also mentioned in Fatawa Hindiyah that it is permissible to kill an animal whose meat is not eaten if it becomes sick as a means of relieving it from its pain.[3]

إذا كثرت الكلاب في قرية وأضرت بأهلها أمر أربابها بقتلها، فإن أبوا رفع الأمر إلى القاضي حتى يأمر بذلك
